Accommodation Agreement

Article 1 — Scope of Application
1. The accommodation contract and related agreements entered into by this hotel with the guest shall be in accordance with the provisions of these general terms and conditions, and any matters not provided for in these general terms and conditions shall be in accordance with laws and regulations or generally accepted customs.
2. If this hotel agrees to a special agreement to the extent that it does not contravene laws and customs, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.
Article 2 — Application for Accommodation
A person who wishes to apply for a contract of accommodation at this hotel shall provide the following information to this hotel.
  • (1) Name of guest
  • (2) Date of stay and estimated time of arrival
  • (3) Accommodation fees
  • (4) Other matters deemed necessary by the hotel
In the event that a guest requests to continue his/her stay beyond the date of stay as stipulated in item 2 of the preceding paragraph during his/her stay, this hotel shall treat such request as a new application for a contract of stay at the time such request is made.
Article 3 — Conclusion of the Contract
The accommodation contract shall be concluded when this hotel has accepted the application as described in the preceding article. However, this shall not apply when this hotel proves that it did not accept the application.
2. When a contract of accommodation has been concluded pursuant to the provisions of the preceding paragraph, an application fee determined by this hotel shall be paid by the date designated by this hotel within the limit of the basic accommodation charge for the period of stay (if exceeding 3 days, for 3 days).
3. The deposit shall first be applied to the room charge ultimately payable by the guest, and if a situation arises where the provisions of Articles 6 and 17 apply, the deposit shall be applied in the order of penalty followed by compensation, and any balance shall be returned at the time of payment of the charges pursuant to Article 11.
4. In the event that the reservation deposit as set forth in Paragraph 2 is not paid by the date designated by this hotel pursuant to the provisions of said Paragraph, the accommodation contract shall cease to be effective. However, this shall apply only in the event that this hotel has notified the guest to that effect when designating the date for payment of the application fee.
Article 4 (Special clause that the application fee is not required to be paid)
1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may accept a special agreement that does not require the payment of the application fee as specified in the same paragraph after the contract is concluded.
2. In the event that this hotel, in accepting an application for a contract of accommodation, does not request payment of the application fee as set forth in Paragraph 2 of the preceding article or does not specify the date for payment of said application fee, this hotel shall be deemed to have complied with the special provisions of the preceding paragraph.
Article 5 — Right to Refuse Accommodation
This hotel shall not respond to requests for accommodation contracts in the following cases
  • (1) When an application for accommodation is not in accordance with these general terms and conditions.
  • (2) When there is no room available due to full occupancy.
  • (3) When it is recognized that the person who intends to stay is likely to commit an act contrary to the provisions of laws and regulations, public order, or good morals in connection with the stay.
  • (4) When it is recognized that the person who intends to stay falls under any of the following items (a) through (c).
    • (a) Boryokudan (organized crime groups) prescribed in Article 2, item 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Groups (Law No. 77, 1991) (hereinafter referred to as "Boryokudan") (hereinafter referred to as "Boryokudan"), Boryokudan members prescribed in Article 2, item 6 of the same law (hereinafter referred to as "Boryokudan Member") (ii) When the applicant is a Boryokudan, a quasi-organized member of a Boryokudan, or a person related to a Boryokudan member, or any other antisocial force.
    • (b) When it is a Boryokudan or a juridical person or other organization in which Boryokudan members control business activities.
    • (c) When a juridical person has an officer who falls under the category of a Bouryokudan Member
  • (5) When a person who intends to stay at the hotel has said or done something that causes significant inconvenience to other guests.
  • (6) When it is clearly recognized that the person who intends to stay is suffering from a contagious disease.
  • (7) When a violent act of demand is committed or a burden exceeding a reasonable range is demanded in connection with accommodation.
  • (8) When it is impossible to accommodate guests due to natural disasters, breakdown of facilities, or other unavoidable reasons.
  • (9) When the person who intends to stay at the hotel is recognized by the hotel to be in the following conditions as stipulated in Article 5 of the Okinawa Prefecture Ryokan Law Enforcement Regulations.
    • (I) Drunkenness or extremely abnormal speech or behavior that disturbs other guests.
    • (II) Body and clothes are extremely unclean and make guests feel uncomfortable.
  • (10) When the guest has previously committed any of the acts listed in (3), (7), or (9) of this article at this hotel.
Article 6 — Guest’s Right to Cancel the Contract
The guest may cancel the accommodation contract by making a request to this hotel.
In the event that the guest cancels all or part of the accommodation contract due to reasons attributable to the guest (except in the event that this hotel specifies the due date for payment of the application fee and requests payment thereof pursuant to Article 3, paragraph 2, and the guest cancels the accommodation contract prior to such payment), this hotel shall charge a penalty fee in accordance with Appendix 1. ), a penalty charge shall be applied in accordance with the provisions of Appended Table 1. However, in the event that this hotel accepts the special contract stipulated in Article 4, Paragraph 1, it is only when this hotel has notified the guest of the obligation to pay the penalty when the guest cancels the accommodation contract in accepting such special contract.
If the guest does not arrive at the hotel by 8:00 p.m. on the day of the stay (or 2 hours after the estimated time of arrival, if such time has been specified in advance), this hotel may deem the accommodation contract to have been cancelled by the guest.

Article 7 (Hotel's Right to Cancel Contract)
This hotel may cancel the accommodation contract in the following cases. In no event shall this hotel be liable for any damages resulting from the cancellation of the contract in accordance with this article.
(1) When one of the items in Article 5 of the Accommodation Agreement applies, or is found to apply during use of the hotel.
(2) When a guest does not comply with the prohibitions of the hotel's rules of use (limited to those necessary for fire prevention), such as smoking in the bedroom, tampering with firefighting equipment, etc. (3) When a guest does not comply with the rules and regulations of the hotel (limited to those necessary for fire prevention).
2. When this hotel cancels the accommodation contract pursuant to the provisions of the preceding paragraph, no charge for accommodation services, etc. that have not yet been provided to the guest will be made.
Article 8 — Guest Registration
Guests are requested to register the following items at the front desk of this hotel on the day of their stay.
(1) Name, age, sex, address and occupation of the guest
(2) For foreign nationals, nationality, passport number, place of entry and date of entry
(3) Departure date and scheduled departure time
(4) Other matters deemed necessary by the hotel
2. When a guest intends to pay the charges in accordance with Article 11 by a method that can be substituted for currency, such as a traveler's check, hotel voucher, or credit card, the guest shall present them in advance at the time of registration in accordance with the preceding paragraph.
Article 9 (Hours of Use of Guest Rooms)
Guests may use their rooms from 3:00 p.m. to 10:00 a.m. the following morning. However, in the case of a consecutive stay, the guest may use the room for the entire day, except for the day of arrival and the day of departure.
2. Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of rooms outside the hours specified in the same paragraph. Please inquire at the front desk for details.
Article 10 — Compliance with House Rules
Guests shall follow the rules of use established by the hotel and posted in the hotel.
Article 11 (Payment of Charges)
1. The accommodation charges to be paid by the guest and the method of settlement shall be in accordance with the Hotel's Rules and Regulations.
2. Payment of the accommodation charge, etc. as described in the preceding paragraph shall be made at the front desk at the time of check-in or when requested by this hotel, in currency or by a method acceptable to this hotel, such as travel checks, accommodation vouchers, credit cards, etc., which may be substituted therefor.
3. The hotel will charge a room charge even if the guest voluntarily does not stay in the room after the hotel has provided the room to the guest and made it available for use.
Article 12 (Liability of the Hotel)
1. This hotel will compensate for any damage caused to the guest in the performance of the accommodation contract and related agreements, or in the event of non-fulfillment of such agreements. However, this shall not apply when the damage is not caused by reasons attributable to this hotel.
2. The hotel has Ryokan liability insurance to protect against fire, etc. in case of emergency.
Article 13 (Handling of Contracted Guest Rooms When Not Provided)
In the event that this hotel is unable to provide the guest with the contracted room, this hotel shall, with the consent of the guest, arrange other accommodations with the same conditions as far as possible.
2. If, notwithstanding the provisions of the preceding paragraph, this hotel is unable to find other accommodation, it will pay the guest a compensation fee equivalent to the amount of the penalty charge, which will be applied to the amount of compensation for damages. However, if there is no reason attributable to this hotel for not being able to provide the guest room, no compensation fee will be paid.
Article 14 (Handling of Deposited Property, etc.)
In the event of loss, damage or other loss of or damage to articles, cash or valuables left at the front desk by a guest, this hotel will compensate for such damage, except in cases of force majeure.
2. In the event of loss, damage or other damage caused by the intentional or negligent act of this hotel to articles, cash or valuables brought to this hotel by a guest and not left at the front desk, this hotel will compensate for such damage.
Article 15 (Custody of Luggage or Personal Effects of Guests)
In the event that a guest's baggage arrives at this hotel prior to his/her stay, the hotel will take responsibility for its safekeeping only if the hotel understands this prior to the arrival of the baggage, and hand it over to the guest when he/she checks in at the front desk.
In the event that a guest's luggage or personal belongings are left at this hotel after the guest has checked out, and the owner is found, this hotel shall contact the owner and request instructions from him or her. However, if the owner's instructions are not given, or if the owner cannot be identified, the hotel will keep the property for 7 days including the day of discovery, and then report the matter to the nearest police station.
3. The responsibility of this hotel for the custody of the guest's baggage or personal belongings in the case of the preceding two paragraphs shall conform to the provisions of paragraph 1 of the preceding article in the case of paragraph 1, and to the provisions of paragraph 2 of the same article in the case of the preceding paragraph.
Article 16 (Responsibility for Parking)
When a guest uses the parking lot of this hotel, regardless of whether or not the guest has deposited the keys to the vehicle, this hotel rents the parking lot to the guest and is not responsible for the storage of the vehicle. However, in the event that damage is caused by the hotel's intentional or negligent management of the parking lot, the hotel shall be liable for the damage.
Article 17 (Guest Responsibility)
In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel for such damages.
Article 18 (Disclaimer)
The use of computer communications from within the hotel is at the user's own risk. The Hotel shall not be liable for any damages incurred by the user as a result of service interruption due to system failure or any other reason during the use of computer communications. In addition, in the event that the Hotel or a third party suffers damages as a result of an act that the Hotel deems inappropriate for the use of computer communications, the Hotel shall compensate the third party for such damages.
